You and your spouse may complete an uncontested divorce in New York State if you completely agree on all the issues in a divorce.

In an uncontested divorce, there is simply nothing to argue about. You will need to agree completely on how to divide the marital property, to establish custody of the children (if any), and to set up support (child and/or spousal) payments (as may be desired or required). If you are not in near, but not complete, agreement on all the issues, it suggests you can negotiate civilly with your spouse. You may want to try divorce mediation to hammer out those remaining details.
Even if you are in agreement on all the terms of the divorce, you still need to file the requisite papers in court, which can be a complicated, time-consuming process, and a challenge to do on your own if you are unfamiliar with court process. And if the papers are not done correctly, they may be rejected by the court.
